KTAMS President Güven Bengihan, together with KTAMS lawyer Yusuf Kahyalar and accompanying union members, made a press statement in front of the Nicosia District Court and then filed the case.
Bengihan said in a statement that, as per the law numbered 33/2019, 1 percent of the expenditures made with credit and debit cards should be returned to individuals, but the relevant law has not been implemented for more than three years and the Ministry of Finance has still not responded to the petition they submitted about 8 months ago. He pleaded not guilty to committing a crime.
Pointing out that the country has been going through bad times both socially and economically in recent days, Bengihan criticized the government’s failure to take any steps in this regard, especially when there are hundreds of thousands of people working in the private sector for minimum wage and staying below the hunger limit.
Bengihan, who argued that the financial resources were used rudely and public resources were given away, just before the elections, Bengihan suggested that the election bans were withdrawn from 2 months to 1 month, and the government’s intention was to create more employment.
Bengihan said that at a time when the reorganization of the minimum wage and the reflection of the cost of living should be talked about, changes were made to the manager and undersecretary just before the elections. We are also disturbed by this.” Stating that while there is a law passed unanimously by the Parliament in 2019, 1% of all purchases made by the people with credit cards and ATMs should be paid to the public, Bengihan said, despite warnings many times for almost 4 years and for about 8 months. He noted that although they filed a petition to the Ministry of Finance about the issue before, their petitions were not even answered.
Bengihan pointed out that the petition made within the scope of the Good Administration Law must be answered within 1 month, and noted that the Good Administration Law also regulates filing a lawsuit if the petition is not answered within 1 month.
Bengihan stated that the Good Administration Law orders the administration to fulfill its obligations within a reasonable time, and that the Ministry of Finance has not fulfilled its obligations within a reasonable time and emphasized that the administration is also obliged to compensate for the damage arising from its own actions, negligence and actions.
Bengihan also stated that there is a loss arising from the act resulting from this negligence, and that the Ministry of Finance should compensate for this loss.
Explaining that the law was enacted to encourage the use of credit and debit cards in order to prevent the informal economy, Bengihan reminded that the workplaces that did not issue invoices and receipts were identified and the law was enacted in order to prevent informality.
